Terms of Service

Stack Stitch is in early access. Our legal entity is being formed and these Terms are under legal review; they will be updated before general availability.

By creating an account, installing, or using Stack Stitch (the "Service"), you agree to these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind it. If you do not agree, do not use the Service.

1. Who we are

The Service is operated by StackStitch, currently run by its founding team based in Colombia ("we", "us"); a legal entity is being formed and these Terms will be updated to name it once incorporated. Contact: hello@stackstitch.dev.

2. Eligibility

You must be 18 or older and able to form a binding contract. If you connect data belonging to an employer or organization, you represent that you have authority to do so.

3. The Service (and its status)

Stack Stitch connects to tools you use (Slack, GitHub, Jira/Linear, and optionally your calls) and proactively surfaces relevant context with sources attached. The Service is currently offered in an early-access stage and is provided "as is"; features may change, break, or be discontinued, and availability is not guaranteed.

4. Your account

You sign in via Google / Firebase. You are responsible for activity under your account and for keeping access secure. Notify us of any unauthorized use.

5. Connected services & your authority

You may connect third-party services via OAuth. You are responsible for complying with those services' terms and for having the right and authority to connect them and to allow us to process the resulting data (including data about third parties). You can disconnect a source at any time. We are not responsible for third-party services or their availability.

6. Call recording — your responsibility

Call capture is off by default. If you enable it, you alone are responsible for complying with all applicable recording, wiretapping and privacy laws, including obtaining the consent of all participants where required, and for informing participants that a call is being recorded and transcribed. Before capturing a call you must confirm, via an in-app acknowledgment, that you have consent from all participants ("I confirm I have consent from all participants to record and transcribe this call"). You agree not to use the feature unlawfully. We provide the tool; you control its use, and you indemnify us for any claim arising from your recording (see §16).

7. AI features — no reliance / not professional advice

The Service uses AI to generate proactive notifications, summaries and suggestions. AI output may be inaccurate, incomplete, or out of date. It is provided for informational purposes only, is not professional (legal, financial, security, or engineering) advice, and you must independently verify anything you rely on. You are responsible for decisions you make based on the Service.

8. Acceptable use

You agree not to: use the Service unlawfully or to violate others' rights; connect data you have no right to access; attempt to breach security, tenant isolation, or access other users' data; reverse-engineer or resell the Service except as permitted by law; or use it to build a competing product by scraping. We may suspend accounts that violate these Terms.

10. Your content & license to operate

As between you and us, you retain ownership of the content you connect or create ("Your Content"). You grant us a limited, non-exclusive license to host, process, transmit, and create derived data (artifacts, notifications, correlated context, embeddings) from Your Content solely to provide and improve the Service to you, including sending relevant excerpts to AI sub-processors (see the Privacy Policy). We do not sell Your Content.

Improvement & training stance: we may use aggregated and de-identified data (which does not identify you or any person) to operate, secure, measure and improve the Service. We do not use Your Content or call transcripts to train our own or third parties' models, and — where the AI provider offers the option — we configure them not to train on Your Content.

11. Our intellectual property

The Service, software, and brand ("Stack Stitch") are owned by us and our licensors. These Terms grant you a limited, revocable, non-transferable right to use the Service; no other rights are granted.

12. Privacy

Your use is also governed by our Privacy Policy, which describes what we collect, our sub-processors, and your rights.

13. Term & termination

You may stop using and delete your account at any time. We may suspend or terminate access for breach of these Terms, legal risk, or discontinuation of the Service. On termination, your right to use the Service ends; data handling follows the Privacy Policy (retention).

14. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind (express or implied), including merchantability, fitness for a particular purpose, accuracy of AI output, or uninterrupted/error-free operation, to the maximum extent permitted by law.

15. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim is limited to the greater of the amounts you paid us in the 3 months before the claim, or USD 100.

16. Indemnification

You agree to indemnify and hold us harmless from claims arising out of: your misuse of the Service; your connecting or recording data without authority or consent; your violation of these Terms, applicable law, or third-party rights.

17. Changes to these Terms

We may update these Terms; material changes will be notified via the app or stackstitch.dev. Continued use after changes means you accept them.

18. Governing law & disputes

These Terms are governed by the laws of Colombia, without regard to conflict-of-laws rules. Disputes are subject to the competent courts of Bogotá, Colombia, except where mandatory consumer law gives you other rights.
